Battered Woman Syndrome and Trial

Battered Woman Syndrome and Trial

Domestic abuse affects many areas and charges throughout the legal system.  It can often be challenging to get the right information to the judge and jury.

A11-0749        State of Minnesota vs. Betsy Marie Hanks

The district court did not err when it excluded the proffered expert testimony on battered woman syndrome.
The district court did not violate the defendant's constitutional right to present a defense when it excluded some evidence of alleged threats made by the victim to harm the defendant and bruises on the defendant.

Affirmed in part, reversed in part, and remanded.

You know a whole lot its almost hard to argue with you (not
that I really will need to…HaHa). You certainly put a brand new spin on a subject that's
been discussed for a long time. Great stuff, just great!
