When you are charged with stalking, the State is claiming that your behavior caused another person (the alleged victim) to feel threatened, intimidated or frightened. Some types of stalking behavior are considered continuously calling, texting, mailing, emailing, or otherwise communicating, or following another person.  Even if you had no previous contact with the other person, it is important that you avoid them, do not talk to the police, and call us.

Possible Sentences:

  • If this is the first time the State has charged you with stalking, you will more than likely be charged with a Gross Misdemeanor stalking under Minn. Stat. § 609.749. A gross misdemeanor is a criminal offense that can result in up to 1 year in jail, a fine of up to $3,000, or both.
  • Under this statute, stalking is an “enhanceable” crime, meaning that if there are certain other factors or you have other stalking convictions, you could be facing Felony Stalking charges.  Felony Stalking can result in a prison sentence of up to ten years, a fine of up to $20,000, or both. If you are charged with Felony Stalking, the Court may also order you to undergo a mental health assessment and treatment.
  • If the State alleges you used a firearm while stalking, the Court can prohibit you from possessing any type of firearm for a period longer than three years or for the remainder of your life.
